Following the publication of the delegated acts on fire performance, the European Commission has adopted Commission Delegated Regulation (EU) 2026/1310, marking a further step in the implementation of the new Construction Products Regulation (CPR).
The Regulation plays a key role as it identifies the Assessment and Verification Systems (AVS) applicable to the various families and categories of construction products, in relation to their essential characteristics and, where applicable, the requirements established under the new regulatory framework.
With the new CPR, the European Union is updating the harmonised rules governing the placing of construction products on the market. To make this framework operational, it was necessary to clearly define which activities fall under the responsibility of manufacturers and what level of involvement is required from notified bodies.
Delegated Regulation (EU) 2026/1310 addresses precisely this aspect.
In essence, the Regulation clarifies which parties are responsible for carrying out the relevant assessment and verification activities required to demonstrate conformity with the declared performance, thereby supporting the future use of CE marking under Regulation (EU) 2024/3110.

The Commission has retained an approach that is largely consistent with Regulation (EU) No 305/2011, introducing only limited changes to the existing AVS systems and establishing the new System 3+ for the assessment of environmental sustainability.
The allocation of AVS systems has been determined by taking several factors into account, including:
the intended use of the product;
the potential consequences of product defects or inadequate performance;
the complexity and sensitivity of the manufacturing process;
the possibility of detecting manufacturing errors.
The objective is to strike a balance between protecting health, safety and the environment and limiting the administrative and compliance burden placed on manufacturers.
The Annex to the Regulation assigns assessment and verification systems to a broad range of product families, including:
doors, windows and related products;
curtain walling;
flat glass and structural glass products;
thermal insulation products;
precast concrete products;
structural steel and timber products;
waterproofing products;
aggregates, cements and concrete;
fire protection products;
products for road and railway infrastructure;
fixings, anchors and construction systems.
The applicable AVS system does not depend solely on the product category, but also on the specific performance to be declared and verified.
A particularly significant aspect concerns certain “horizontal” characteristics, which are relevant to a wide range of product families.
The main characteristics include:
reaction to fire;
external fire performance;
emission and content of dangerous substances;
environmental sustainability.
For these characteristics, the Regulation establishes specific criteria that apply irrespective of the individual product family.
This approach confirms the increasing attention paid by the European legislator to issues such as fire safety, health protection and environmental sustainability.
Delegated Regulation (EU) 2026/1310 does not directly introduce new technical requirements for construction products.
However, it represents an essential component of the new CPR framework, as it provides a basis for the development of:
future harmonised technical specifications;
standardisation requests addressed to CEN;
European Assessment Documents (EADs);
future CE marking schemes.
For manufacturers, this Delegated Regulation is therefore an important reference document that deserves careful consideration. It provides an early indication of the level of involvement of notified bodies in the assessment and verification of product performance and helps manufacturers prepare for the future implementing provisions of Regulation (EU) 2024/3110.
